Botha Recalled For Testimony Despite Attempted Murder Charges

Prosecutor Gerrie Nel told the Pretoria Magistrate's Court on Thursday he was caught unawares when reports surfaced that Botha, the investigator in the case was himself charged with seven counts of attempted murder.

"We didn't know," said Nel. "We have heard that he will appear in May."

Magistrate Desmond Nair then asked that Botha be fetched and he called for an adjournment for this purpose.

Botha, along with two other law enforcement officials, faces attempted murder charges for allegedly shooting at a taxi that had seven occupants in it during a drunken episode in 2011.

Nair asked about the incident.

Nel said it happened in December 2011 and that the matter was on the court roll until March 2012. It was then withdrawn, but was later reinstated. The National Prosecuting Authority earlier on Thursday confirmed the charges were reinstated on February 4.

Nel said Botha was in the building and would be fetched.
