KwaZulu-Natal (KZN) Judge President Vuka Tshabalala said on Wednesday that he had returned all the shares in Absa Bank worth millions of rands, which were given to him by a consortium headed by businessman Tokyo Sexwale. ”I have returned the shares. That’s the end of the matter,” said Tshabalala.

Legislation relating to judicial conduct and ethics was unanimously approved in the National Assembly on Tuesday. Minister of Justice and Constitutional Development Brigitte Mabandla said recent controversial incidents regarding alleged indiscretions by members of the judiciary had highlighted the lack of a credible legal framework.

Cape Judge President John Hlophe’s refusal to resign is a typical example of persons holding high office refusing to face the consequences of their actions, says Democratic Alliance (DA) leader Helen Zille. ”By refusing to step down, contrary to the dictates of good governance, such senior office-bearers undermine our young democracy,” she said on Friday.
Chief Justice Pius Langa steered clear on Tuesday of the controversy around Cape Judge President John Hlophe and suspended National Director of Prosecutions Vusi Pikoli. He told students at the University of KwaZulu-Natal in Durban that he knew there were many who wanted him to speak on President Thabo Mbeki’s decision to suspend Pikoli.
The lawful decision by the Judicial Services Commission (JSC) not to continue its inquiry into Cape Judge President John Hlophe has upset some people, the Black Lawyers’ Association (BLA) said on Tuesday. ”It’s an outcome they don’t like,” BLA president Henry Msimang said.
Nine senior advocates from the Cape Bar, some of them former acting judges, have publicly called on Cape Judge President John Hlophe to quit. ”We believe that there cannot be public confidence in the continuation in office now of Judge Hlophe,” they said in a letter published on Tuesday.
The lack of legislation regulating the conduct of judges has resulted in Cape Judge President John Hlophe getting away with a ”slap on the wrist”, the Democratic Alliance (DA) said on Friday. DA spokesperson on justice Sheila Camerer said Hlophe’s case highlighted the need to expedite the passing of such legislation.
No impeachment proceedings will be instituted against Cape Judge President John Hlophe, the Judicial Service Commission (JSC) said on Thursday. Chief Justice Pius Langa said although the JSC members were divided on whether there was sufficient evidence to justify proceedings that could lead to impeachment, it was generally agreed the proceedings should not be pursued.
A former politician and a controversial figure were the only candidates interviewed in Cape Town on Tuesday for a vacant judge position in the Bophuthatswana (North West) provincial division. They are former Democratic Alliance MP Lawrence Lever and former North West acting judge Cecile Zwiegelaar.
