DA leader Helen Zille is planning to have Judge Nathan Erasmus hauled before the Judicial Service Commission.
A full bench of judges on Friday reserved a ruling on the bid by the City of Cape Town and the Democratic Alliance (DA) to quash the Erasmus commission. The commission was set up by Western Cape Premier Ebrahim Rasool to probe the DA-led city’s investigation of renegade councillor Badih Chaaban.
Having a judge head the politically loaded Erasmus commission undermined the principle of separation of powers, lawyers for the City of Cape Town and the Democratic Alliance argued on Thursday. The city and the party have asked the court to quash the commission to probe the legality of the city’s spying on renegade councillor Badih Chaaban.
Democratic Alliance leader Helen Zille on Monday vowed to take her fight against the Erasmus commission to the Constitutional Court. The commission was set up by Western Cape Premier Ebrahim Rasool in December 2007 to investigate the City of Cape Town’s probe into controversial councillor Badih Chaaban.
The Erasmus commission’s sittings have been suspended pending the City of Cape Town’s application to the Cape High Court challenging the commission’s legality. This emerged after a day of behind-the-scenes negotiations on Wednesday between the legal representatives of the various parties involved.
The Erasmus commission is facing three new urgent interdicts to put its activities in Cape Town on hold, prompting commission chairperson Judge Nathan Erasmus to adjourn proceedings on Tuesday afternoon. The interdicts are expected to be heard in the Cape High Court on Wednesday morning.

The Erasmus commission, appointed to look into the Cape Town city council ”spy” saga, has suspended its hearings following a request on Monday by Western Cape Premier Ebrahim Rasool, who says he is seeking legal advice on the inquiry. Rasool’s request was prompted by objections from Cape Town mayor Helen Zille.

The timetable for hearings into the City of Cape Town’s spy-allegation controversy will be released to the public on Tuesday, the Erasmus Commission of Inquiry said. Commission spokesperson Zithulele Twala on Monday said the commission had already finalised the timetable.
The Erasmus commission, set up to probe Cape Town’s ”spy” saga, has extended the deadline for submissions to the end of this month. Announcing this on Wednesday, commission secretary Zithulele Twala said the extension had been requested by the City of Cape Town and private investigators George Fivaz and Associates.

The Erasmus Commission of Inquiry probing Cape Town’s ”spy saga” is calling for public submissions on the matter. The commission, headed by Judge Nathan Erasmus, has already started studying all available documentation relating to the issue, commission secretary Zithulele Twala said on Wednesday.

Head judge of the Judicial Inspectorate of Prisons Justice Nathan Erasmus will head the commission of inquiry into allegations of illegal surveillance by the City of Cape, Western Cape Premier Ebrahim Rasool and provincial minister for local government and housing Richard Dyantyi said on Friday.

Reformed Hard Livings gang leader Rashied Staggie was on Wednesday found not guilty of the revenge murder of taxi driver Mogamat Ryklief. Staggie appeared in the Cape High Court before Judge Nathan Erasmus, who labelled the only state witness, Donavan Richards, as a ”good liar who manipulated words to suit himself”.
