Former deputy president Jacob Zuma could take the stand in his rape trial on Monday after the Johannesburg High Court turned down an application to have the case discharged on Wednesday. Asked if his client would take the stand when the trial resumed, Zuma’s lawyer Kemp J Kemp would not give a direct answer.

The Johannesburg High Court on Wednesday denied former deputy president Jacob Zuma’s application to be discharged on a rape count. Judge Willem van der Merwe said he could not agree that evidence led by the state was of such a poor quality that it could not be accepted. ”The accused is not entitled to his discharge,” he said.

The medical report of Jacob Zuma’s rape accuser contained no proof of rape, his lawyer Kemp J Kemp told the Johannesburg High Court on Wednesday. ”She reported the incident in terms which clearly did not describe it as rape,” Kemp submitted in final argument during his application for his client’s discharge.

If the rape allegation against Jacob Zuma was part of a political conspiracy against him, it was poorly planned, the state prosecutor told the Johannesburg High Court on Tuesday. ”If there was a political conspiracy, it wasn’t the most well-planned conspiracy,” said Herman Broodryk.

Jacob Zuma’s rape trial discharge application resumed on Tuesday with his lawyer questioning why his accuser ignored a number of what his defence team regard to be sexual messages. A 31-year-old close family friend has alleged that the former deputy president raped her at his home on November 2.
