The Erasmus commission, set up to probe alleged irregularities in the City of Cape Town, is unconstitutional, a court ruled on Monday.
Having a judge head the politically loaded Erasmus commission undermined the principle of separation of powers, lawyers for the City of Cape Town and the Democratic Alliance argued on Thursday. The city and the party have asked the court to quash the commission to probe the legality of the city’s spying on renegade councillor Badih Chaaban.
One of the key motives behind the Erasmus commission was to stop the realignment of South African politics, Democratic Alliance (DA) leader Helen Zille said on Friday. The commission was set up by Western Cape Premier Ebrahim Rasool in December 2007 to investigate the City of Cape Town’s probe into controversial councillor Badih Chaaban.
Democratic Alliance (DA) leader Helen Zille was emerging as a person who would go to extremes to cover up the truth, a former member of the DA said on Tuesday. ”[She is] a person who criticises the judiciary and the media because their duties do not fit her political agenda,” Kobus Brynard, a Western Cape MPL for the African National Congress, said.

The Independent Democrats (ID) on Monday dismissed as false claims by Cape Town mayor Helen Zille that the Democratic Alliance (DA) did not sanction the bribery of ID councillor Sheval Arendse. Simon Grindrod, ID caucus leader for the city, said it was clear that the bribery was done with the full blessing of the DA leadership.

The Erasmus commission appointed to look into the Cape Town city council ”spy” saga is ”unlawful and unconstitutional”, city mayor Helen Zille said on Thursday. Zille said she had written a letter to Western Cape Premier Ebrahim Rasool asking him to reconsider the commission on the grounds that it was a ”gross abuse of power”.

Cape Town mayor Helen Zille was not guilty of any wrongdoing in connection with the city probe into councillor Badih Chaaban, an independent inquiry into the matter has found. ”The allegations around the investigation into councillor Chaaban have been nothing more than a smear campaign,” Zille said on Wednesday.

The Erasmus Commission of Inquiry probing Cape Town’s ”spy saga” is calling for public submissions on the matter. The commission, headed by Judge Nathan Erasmus, has already started studying all available documentation relating to the issue, commission secretary Zithulele Twala said on Wednesday.
