Justice department director general Menzi Simelane had been ”blatantly dishonest” with the Ginwala inquiry into suspended head prosecutor Vusi Pikoli.

The Ginwala hearing has made public a controversial letter from President Thabo Mbeki to Minister of Justice and Constitutional Development Brigitte Mabandla over the handling of a warrant to arrest police national Commissioner Jackie Selebi. ”Since it was in the public domain and since it had been used, there could be no privilege that could attach to the letter,” Dr Frene Ginwala said.
The arrest warrant against police National Commissioner Jackie Selebi was cancelled last year because acting prosecutions boss Mokotedi Mpshe thought the Scorpions might undermine him and serve it while he was still reviewing the matter, the inquiry into Pikoli’s fitness to hold office heard on Friday.
The public hearings on suspended National Prosecuting Authority head Vusi Pikoli’s fitness to hold office are an ”inquisitorial” as opposed to an ”accusatorial” process, inquiry head Frene Ginwala said on Wednesday. ”I want to emphasise that this process is not a judicial one,” said Ginwala in an opening statement.
The inquiry into the suspension of National Prosecuting Authority head Vusi Pikoli, which starts on Wednesday, will see several high-profile witnesses testify, including Reverend Frank Chikane and Scorpions boss Gerrie Nel. President Thabo Mbeki suspended Pikoli as the head of the NPA on September 24.

Suspended National Director of Public Prosecutions Vusi Pikoli has objected to government’s request for an extension to file its submissions to the Ginwala Commission of Inquiry. A copy of a letter, sent by Pikoli’s law firm Denys Reitz to inquiry head Frene Ginwala, was released to the media late on Tuesday. Earlier on Tuesday, Ginwala herself criticised government for its ”slow response” and failure to deliver its submission on time.

Police National Commissioner Jackie Selebi is to be charged with corruption and defeating the course of justice after his application to prevent the National Prosecuting Authority from prosecuting him was denied in the Pretoria High Court on Friday. The National Prosecuting Authority (NPA) is ready to charge police National Commissioner and Interpol chief Jackie Selebi, it said in court papers at the Pretoria High Court on Friday. The NPA said it would charge Selebi with corruption and defeating the course of justice.
The government revised its submission to the Ginwala inquiry into the suspension of National Prosecuting Authority boss Vusi Pikoli after its first draft did not contain enough information, a media report said on Wednesday. The report said Pikoli’s advocate Wim Trengove had complained that the government’s submission was ”too bare”.
The Ginwala inquiry into suspended prosecutions head Vusi Pikoli on Monday announced a timeline for key submissions to it, it was reported. Lawson Naidoo, spokesperson for Frene Ginwala, said they were expecting Minister of Justice and Constitutional Development Brigitte Mabandla’s submission on January 15 and Pikoli’s on January 31.

Government spokesperson Themba Maseko admitted on Thursday that the authorities were worried about the damage being done to the country’s international image by the ongoing saga surrounding suspended National Prosecuting Authority head Vusi Pikoli and police National Commissioner Jackie Selebi.
Forsaking high office in order to build the organisation should be the highest honour for members of the African National Congress (ANC), said the ruling party’s national treasurer Mendi Msimang on Saturday. ”Election to high office in the ANC should not be regarded as a stepping stone to government position or the accumulation of wealth,” he said.
The Congress of South African Trade Unions (Cosatu) on Friday called for a broader political inquiry into the suspension of the director of the National Prosecuting Authority, advocate Vusi Pikoli. ”This has now become more urgent than ever,” spokesperson Patrick Craven said.
