Booze and brothel case judgement this week

Strip club owners and patrons could find themselves legally enjoying their tantalising tipples if Andrew Philips, owner of Sandton’s club The Ranch, wins his case in the Constitutional Court on Thursday.

In June this year the high court ruled in Philip’s favour, saying that sections of the Liquor Act were unconstitutional, but also asked that the Constitutional Court look at its ruling.

On Thursday the 11 judges will consider this ruling.

Philips told Sapa on Wednesday that he was ”reasonably

confident” of success, but said he had also learnt that ”court cases are funny things”.

He said the State did not oppose his high court application, and he understood the State had also withdrawn its intention to oppose it in the Constitutional Court.

”That doesn’t mean you cruise through. The judge still raises his concerns and asks questions,” he said.

Philips called the State’s lack of fight in the high court ”bizarre” after it unleashed the ”full wrath of the law” on him, closing The Ranch down and seizing his assets. – Sapa
