Satirical clothing maker granted appeal

Satirical clothing maker Laugh It Off was granted leave to appeal by the Cape High Court on Monday against a decision barring it from using the Carling Black Label beer trademark, SABC radio news reported.

The company raised the ire of brewing giant SABMiller when it produced a T-shirt with the slogan ”Black Labour — White Guilt”, that played on the logo of its popular Black Label brand of lager.

The brewer took the T-shirt maker to court and the court ruled in favour of SABMiller last month.

Laugh It Off’s representative, Peter Hodes, argued in court on Monday that there was no proof that SABMiller would sell less beer because of the T-shirt.

Advocate Reinhard Michau, for SABMiller, argued that Laugh It Off was not expressing its right to freedom of expression, but trying to make money.

The case will now go to the Supreme Court of Appeal in Bloemfontein. – Sapa
