Jailers tell of Boeremag cell raids

Two Correctional Services officials on Thursday testified that they had not received any complaints after the cells of three of the Boeremag treason trialists were searched and certain documents seized.

Nicolaas Baloyi, head of the Pretoria Local prison and Jacobus Kilian, acting area manager for Correctional Services in Pretoria, testified about an incident in October last year when the cells of Mike du Toit, his brother Andre and Koos du Plessis were searched.

Kilian said he was aware of an incident when Andre du Toit’s asthma pump and medication were seized and a medical orderly had to intervene.

Kilian and Baloyi both testified that they had not received any complaints as a result of the search and seize procedures followed that night.

Baloyi had signed for items seized from the cell of Andre du Toit, because the accused refused to sign for it, but he had never asked the reason for Du Toit’s refusal and did not know what was seized.

He denied that Du Toit had complained to him that certain of the documents were privileged.

The three have applied to have their further prosecution stopped, claiming they had been irreparably prejudiced by the confiscation of privileged documents and that the state had adapted its case as a result of their defence set out in one of the documents.

The trial will continue on October 6. — Sapa
