Marginal gold miner Durban Roodepoort Deep (DRD) will continue to pursue its R3,5-million lawsuit against Roger Kebble for breaching a restraint of trade agreement, DRD CEO Ian Murray said in a statement on Wednesday.
The legal action was heard in the Johannesburg High Court on Tuesday and Kebble’s counsel raised two technical objections to the way DRD’s claim was framed.
One of Kebble’s objections was upheld, while the presiding judge dismissed the other. DRD has three courses of action open to it in respect of the objection that was upheld by the judge.
The company can either use a 20-day opportunity granted by the judge to amend its summons, it may appeal the finding or it can drop the suit.
DRD has ruled out dropping the suit and will pursue the action on the advice of its legal team, Murray said. — I-Net Bridge
