Masetlha to be charged with flouting intelligence Act

Axed spy boss Billy Masetlha will be charged later this week with contravening the Intelligence Services Oversight Act, the Pretoria News reported on Tuesday.

It quoted the office of the intelligence inspector-general as saying: ”We confirm a criminal summons has been issued and is to be served by the police this week.”

Acting chief operations officer Mpho Nchabeleng could not give details of when and where this would happen.

The summons was initially to have been served on Masetlha on Monday.

His lawyer, Imraan Haffegee, said after speaking to the police it was decided that it would take place later this week, probably at the Brooklyn police station in Pretoria.

Haffegee said he had no idea what the summons would contain, but added his client would not be arrested.

The police would only take a statement from Masetlha and hand him the summons to appear in court some time next month.

Masetlha, the former National Intelligence Agency director, was fired by President Thabo Mbeki in March following a hoax e-mail scandal.

Intelligence ministry Inspector General Zolile Ngcakani found that the e-mails — believed to be part of the African National Congress succession battle and which showed an abuse of state resources for party political ends — were a hoax. – Sapa
