Masetlha to be charged in hoax e-mail case

Former spy boss Billy Masetlha is to be added as an accused in the so-called hoax e-mail court case in the Pretoria Commercial Crimes Court in Pretoria.

Software salesperson Muziwendoda Kunene and National Intelligence Agency (NIA) manager for electronic surveillance Funokwakhe Madladla have already been charged with fraud and their case was scheduled to be heard on Friday.

The case had, however, to be postponed after the state indicated that Masetlha, the former director general of the NIA, will be added as an accused.

Glynis Breytenbach, the prosecutor in the case, said a warrant of arrest has been issued for Masetlha.

On Friday Masetlha was in the Hatfield Community Court in a separate but related case where earlier in the week he pleaded not guilty to a charge of withholding information from the inspector general of intelligence, Zolile Ngcakani.

The cases relate to hoax e-mails implicating senior African National Congress (ANC) members in a conspiracy against Jacob Zuma, the ANC deputy president, and Kgalema Motlanthe, the ANC secretary general.

President Thabo Mbeki fired Masetlha from his position in March after details of the hoax e-mail saga became public.

Kunene was contracted by NIA to intercept e-mails and electronic communication. He handed several documents he claimed were intercepted to Madladla.

It was later found that the documents were fabricated and did not originate from the person alleged to have written them.

The fraud case has been postponed to February 9 2007. — Sapa
