Nicholas Preston, an associate at Glyn Marais, Cricket South Africa’s lawyers, told Business Day on Monday they expected further possible delays to the process after Majola’s objection was turned down.
“We anticipate there may be more technical points raised as we get closer to the hearing,” Preston was quoted as saying.
Craig Watt-Pringle, the chairperson of the Johannesburg Bar Council’s governing body, said he appointed Myburgh in line with recommendations made by a ministerial inquiry chaired by retired judge Chris Nicholson.
According to the Nicholson report the chairperson should be “chosen by the chairperson of the society of advocates”, but does not specify which society.
“There are a number of societies of advocates, but if you interpret the Nicholson report to mean Johannesburg, then it can only be me [who should appoint the chairperson],” Watt-Pringle told the newspaper.
“The point taken by Mr Majola’s lawyers is, because the report doesn’t say the Johannesburg Society of Advocates, they interpret it to mean the General Council of the Bar,” he said.
He added that Gerrit Pretorius, chairperson of the General Council of the Bar, had endorsed Myburgh’s appointment.
Majola was suspended in March after R4.7-million in bonuses were paid to CSA staff without clearance from the board or the remuneration committee. – Sapa
