The high court said Western Cape judge president’s arguments were either not sustainable or worthy of a review application and held that the Judicial Service Commission’s directive that he faces an impeachment process stood

The embattled Western Cape judge president lacks a sound argument in law and in his review bid is seeking to disqualify his peers from holding him to account, the high court heard
The court found that the organisation’s past history in ensuring the misconduct inquiry against the Western Cape judge president was reopened refuted, rather than supported, Hlophe’s objections
The application means it is unlikely that Hlophe’s bid to review the misconduct finding against him will be heard this year
The solicitor-general said state legal assistance for the embattled Western Cape judge president ended when the JSC confirmed that he was guilty of misconduct for trying to compromise Concourt judges
The matter will be heard by a judge of the Johannesburg division when the matter is re-enrolled
We must hold faith that law will prevail
