LUYT ASKS JUDGE TO RECUSE HIMSELF

THE South African Rugby Football Union court case took a new turn on Thursday when former chairman Louis Luyt said in an urgent application to the Constitutional Court that the President of the Court, Judge Arthur Chaskalson, and four other judges should recuse themselves from the case. Beeld reports that, in a strong affidavit against Chaskalson and Judges Pius Langa, Albie Sachs, Zack Yacoob and Johann Kriegler, Luyt averred that with their presence on the bench on Tuesday, when the Constitutional Court will hear oral argument in the case, he had ”grounds to suspect” that he would not have a fair trial. Luyt referred to the ”close and warm ties” between the Chaskalson and Mandela families and alleged that Chaskalson’s relationship with Mandela was so close that even the application of existing law could be affected.
