Judge To Rule On Selebi Application On Monday

Judge Meyer Joffe will make a ruling on former police national commissioner Jackie Selebi’s discharge application on Monday, he told the South Gauteng High Court in Johannesburg on Friday.

This, after the former national police commissioner’s legal team told the court he was entitled to an acquittal on his corruption and defeating the ends of justice charges as the state had failed to prove his guilt.

Defence attorney Jaap Cilliers told the court on Wednesday and Thursday that the state had based its case on an unreliable witness, Glenn Agliotti, whose evidence contradicted information contained in the charge sheet.

The state refuted this, saying discrepancies in Agliotti’s evidence were no grounds to discharge the state’s case.

“It is the state’s argument that we have done more than present evidence upon which the accused might reasonable be convicted.

“… We respectfully submit that we have made out a prima facie case that the accused is guilty of corruption and defeating the ends of justice,” said state prosecutor Gerrie Nel, who wrapped up his arguments in opposition to the acquittal on Friday morning.

Joffe will deliver his judgement at 11.30am on Monday. — Sapa
