Editorial: Mbenenge must resign regardless of the tribunal’s finding

Listening to the hearing of the sexual harassment complaint against Eastern Cape judge president Selby Mbenenge leaves one with the indelible image of a senior member of the judiciary endlessly sexting an office junior while he should have been reading court papers and writing judgments.

The impression is so graphic because his text messages were so graphic. Mbenenge denies that he sent Andiswa Mengo pictures of his penis and a deluge of pornographic images.

But the admitted evidence is replete with text requests for sexual favours that the judge’s own legal counsel qualified as sleazy and puerile.

Mbenenge’s future turns on whether the tribunal finds that Mengo consented to his advances. Advocate Muzi Sikhakhane has argued forcefully that she did and that the infamous photograph that has tarnished his client’s reputation was a fiction.

Mengo has not always been a sympathetic witness and the image may or may not be found, but public perception has little to do with proof and Mbenenge sullied his own standing when he felt entitled to treat a secretary in the division as his toy. 

Judges must command the respect of society because the rule of law depends on public confidence in the integrity of the judiciary.

It is a point that has repeatedly been made in recent years as politicians facing criminal charges or protesting adverse court rulings launched corrosive attacks on individual judges and the court as a collective. Yet the assault on the sanctity of the judiciary has also come from within its ranks, John Hlophe having led the charge. 

Retired Gauteng judge president Bernard Ngoepe initially wanted to hear testimony on the disputed evidence against Mbenenge in camera for the stated reason that if public, it will damage the image of the judiciary.

We know now that the evidence in dispute is the photographs. With respect to Ngoepe,  the transcript of those text messages the respondent cannot disown already reads as a discredit to the institution.

It shows Mbenenge speculating in a troublingly prurient manner that Mengo’s teenage daughter might see their messages. In another message he deplored gender-based violence but saw fit to illustrate the subject with an image of a woman wearing only a t-shirt. 

He should acknowledge that his behaviour was unbecoming and resign, regardless of the conclusion the judicial conduct tribunal reaches. It is the biggest service he can render the judiciary and the only route to personal redemption.

  2. I see the article justifies a clearly morally compromised woman own act of feeding fuel to the JP lust. At one point she even asked for money, called him “cute” and laughed hysterically to his sexually suggestive messages. She made fun of GBV victim, she talked about her being “marinated” and “hot and ready”. This is certainly how a powerless victim against a top authority would behave, she seemed to enjoy the interaction

  3. He is just a silly boy, not deserving respect at all. Shame, she sent salacious texts to put him off, a silly woman not to be taken seriously. Both should be unemployed.

  5. Indeed, as a retired myself this Mampara is a horrible disgrace to the judiciary and legal profession as a whole, which is why I’m so relieved to not be part of it anymore. SIES!!!

  7. Yes, probably, the JP should resign because his image has been tainted by the revelation of sexual flirtation between the two, but I have no doubt in my mind that this case is an orchestrated plot by the JP’s enemies and rivals to eliminate him from the system.

  9. My questions : How do you ,a respected figure in the Legal fraternity and SA community at large,begin to eye your subordinates with lust to the extent of having an affair?

    How easy is it for a single parent to ward off a man of this stature who can in no time make you join the ranks of the millions unemployed of SA?

    How many employers make freely available to their employees policies on work places sexual abuse and of those who have how many will act swiftly to allegations of abuse with true empathy & no biase?

    Please remember there’s a big difference between “what could have happened and what really happened.”

    Men must respect themselves & their families and then they’ll automatically respect the next person.
    It’s so easy to know what should have happened when you were not there in the first place. But I will always find the initiator as the hooligan and the ruthless one with no respect or empathy for women especially in this case.

  10. according to my understanding this affair between Mbenenge and Mango it started long ago they were both in love mango was a mistress…. how did she get a position from where she is working now? this should be perused…
    they were together in this so called affair…every cellphone conversations should be traced, and the investigators should go through MBENENGE’S mid aged friend and ask them people who use to work with him before, cause if you are a perv it doesn’t start at age 63 they both know each other in an out a lot of favors were done for Mango, when someone does such to you as woman you talk about it from the beginning.
    and now she is tired of the old guy.
    I AM NOT SAYING I’M CORRECT this should be investigated in all angels please. women are very smart species.

    • I agree that thus behavior has not started at this age but the bad part of it is that his victims back in the days do not want to come forward and spill the beans. Power dynamics are are at play here. Thee writing is on the wall when he always reminding this girl to delete proves that he is the expert on this behavior.
      The whole Judge to spend his entire time sending love messages to the junior employee instead of taking care of his family and write judgments.

    • I personally support this girl no matter what the tribunal says.
      She must never blame herself. She has stood up for the majority of all Secretaries who have been receiving his private part.

      They are quite but they know the truth wherever they are.
